Police office at scene of an accident between a car and motorcycle.

The statistics are clear: Motorcycle accidents are dangerous. Motorcyclists are significantly more likely to be injured or even killed in a crash than occupants of a passenger vehicle

Because of these risks and the potential for expensive recovery costs, it’s natural to wonder what compensation looks like if you’re injured in a motorcycle accident. We’ll cover that and answer the following questions:

  • Does no-fault insurance cover motorcycle accidents?
  • What damages can you recover for a motorcycle accident?
  • What do the average motorcycle payouts look like?

Nobody wants to be in an accident, but these resources should help you know what to expect if the unexpected ever happens.

The Factors That Influence Motorcycle Accident Damages

Any discussion of compensation for legal settlements is going to begin with the disclaimer that it depends on a variety of factors. Every decision follows a complex process that takes multiple considerations into account. Here are some of the most common:

  • Liability: In several states, including Utah, the damages you’re permitted to seek are contingent on whether you’re found to be at fault and to what extent. You can seek greater damages if you’re completely blameless; on the other hand, if you’re found to be 51% or more responsible for the accident, you are barred from seeking compensation.
  • Injury Severity: As a general rule, more severe injuries with a lengthier road to recovery result in higher damages.
  • Insurance Coverage: The insurance company for the at-fault party will negotiate settlements that fall within the caps they’ve determined for the incident. If you go to trial, there may be a judgment that exceeds that limit, but the insurance company isn’t generally required to pay out past the limits outlined in the policy. Other damages fall to the at-fault party, although the ability to recover large amounts can be limited.
  • Economic Damages: Documented expenses like medical bills, motorcycle repair costs, and lost income from time off work may be taken into account when calculating total damages.
  • Pain and Suffering: The emotional and physical challenges and loss of life enjoyment due to the accident can be considered for total compensation. These elements can be harder to prove than documented economic losses.
  • Representation: Insurance companies look out for their own interest, and the legal system can be difficult for regular people to navigate. An experienced motorcycle attorney knows the steps to take to fight for maximum compensation.

The Average Payouts for Motorcycle Accidents

We recommend discussing your case with an experienced attorney in your area who can give you an idea of what to expect. Remember that numerous factors influence the final compensation amount; averages have very little bearing on the reality you may be facing if you’re in this situation.

That being said, a national average of $73,700 in damages has been reported in motorcycle accidents, following a personal injury trial.

Does No-Fault Insurance Cover Motorcycle Accidents in Utah?

While this may be different in other states, the same no-fault laws that help protect passenger vehicles do not apply to motorcycle accidents in Utah. Motorcycle drivers are not required to carry personal injury protection (PIP) coverage and, in fact, are not permitted to access those benefits.

Many motorcyclists choose to supplement their coverage with policy add-ons for additional protection in the case of an accident. If they are at fault in the accident, such policies (and their own health insurance) may comprise their primary means of compensation.

If the motorcycle driver is not at fault, they can pursue damages against the at-fault driver and their insurance company.
